New
Industrial Relations voluntary dispute resolution legislation
enacted.
On
the 9th March last the Industrial Relations (Miscellaneous
Provisions) Act 2004 was enacted subject to the making of
the necessary Commencement Orders. The Act amends the existing
Industrial Relations legislation framework and provides
for amendments to dispute resolution procedures in the absence
of collective bargaining arrangements.
Among
the main provisions of this new legislation are the following:

The
Code of Practice on Voluntary Dispute Resolution under
the Industrial Relations Act 1990 is amended.

A
new Code of Practice prohibiting victimisation of an
employee by the employer, a fellow employee or trade
union is provided for.

Complaints
regarding victimisation may be made to the Rights Commissioner.
-
Payments
made by the Minister to employees under the Protection
of Employees (Employers' Insolvency) legislation may
be recovered by the Minister as a priority debt in certain
circumstances.
