2003 - Legislation to regulate the use of Electronic Communications
Networks and Services and the implications for Data Protection Privacy
comes into force.
On the 6th of November 2003 the Minister for Communications, Marine
and Natural Resources signed the European Communities (Electronic
Communications Networks and Services) (Data Protection and Privacy)
Regulations 2003 (S.I. No. 523 of 2003) which transposed into Irish
Law the provisions of EU Directive 2003/58/EC concerning the processing
of personal data and the protection of privacy in the electronic
communications sector.

2003 - Important new Data Protection Act legislation in force since
1st July.
On the 1st July 2003 the Data Protection (Amendment) Act 2003 came
into force. This important legislation substantially updates Irish
Data Protection law by giving full effect to EU Directive 95/46
on Data Protection.

2003 - New legislation amending Irish Data Protection Law has come
into force
On the 10th April 2003 the Data Protection (Amendment) Act 2003
was signed into law. This new legislation substantially updates
the Data Protection Act 1988 and gives full effect to the provisions
of the EU Data Protection Directive (95/46/EC).

New Regulations transposing the remaining portions
of the E-Commerce Directive have come into force
On
the 26th February 2003 the Minister of Enterprise Trade & Employment
signed the European Communities (Directive 2000/31/ EC) Regulations
2003 to give effect to those remaining provisions of the E-Commerce
Directive (2001/31/EC) not transposed into Irish law by the Electronic
Commerce Act 2000.

New
EU VAT Directive and Regulation applicable to the delivery of electronic
services
A new EU Directive and Regulation modifying the rules for applying
VAT to certain electronic services were adopted by the EU Commission
on the 7th May 2002. Broadly speaking, these new rules will ensure
that when electronic services are being supplied from outside the
EU to consumers within the EU (B2C), they will be subject to EU
VAT and that when such services are being exported from the EU to
outside of the EU, they will be exempt from VAT.

Data Protection Rules come into force
The
European Communities (Data Protection) Regulations, 2001 (the Regulations)
became law on the 1st April 2002, giving partial effect to the provisions
of the EU Data Protection Directive (95/46/EC) of the 24th October
1995 (the Data Protection Directive).

EU Commission adopts a proposal to fight Cybercrime
On the 19th April 2002 the EU Commission adopted a proposal to go
to the Council of Ministers, the European Parliament, the Economic
and Social Committee and the Committee of the Regions seeking a
decision on a framework to harmonise the criminal law of member
states to combat attacks on information systems and to better promote
information security across the EU.

New ".eu" Top Level Domain Name
On
the 25th March 2002, the EU Council of Ministers gave final approval
for the establishment of a ".eu" Top Level Domain Name
(TLD), the establishment of which has been the stated objective
of the EU Commission for some time.

The
Electronic Commerce Act, 2000
The
Electronic Commerce Act, 2000 (the Act) became law on the 20th September
2000. The Act is premised on two fundamental principles. The first
is to provide for the legal recognition of electronic signatures,
electronic writing and electronic contracts so as to ensure that
such electronic communications would not be treated any differently
under the law, than traditional paper-based communications. The
second founding principle was to draft the legislation in as technologically
neutral a fashion as possible, so as to make it future-proof.
