The
policy and practice of the rules governing public procurement
by state and other awarding authorities under the relevant EU
Public Procurement Directives is a hugely important area. These
Directives constitute the framework within which public bodies
with responsibility for awarding contracts (above certain thresholds)
in the services, supplies, works and utility sectors, must operate.
With the enactment of the State Authorities (Public Private Partnership
Arrangements) Act, 2002 Ireland now has a domestic statutory framework
to facilitate public private partnerships. This will have a significant
bearing on how major infrastructural projects are financed and built.
